Recruiter Terms and Conditions

Introduction

Welcome to Gorec.ai ("Gorec.ai", "Company", "we", "our", or "us").

These Recruiter Terms and Conditions ("Terms") govern your access to and use of the Gorec.ai website, recruitment platform, AI-powered hiring tools, candidate database, sourcing services, recruitment consultancy services, and all related products and services (collectively, the "Platform") as a recruiter or employer user.

By creating an account, accessing, browsing, registering, purchasing credits, using any service, or otherwise interacting with the Platform, you agree to be legally bound by these Terms and our Privacy Policy.

If you do not agree with these Terms, you must not use the Platform.

1. Eligibility

You may use Gorec.ai as a recruiter only if:

• You are at least 18 years old.

• You have the authority to enter into legally binding agreements.

• You are acting on behalf of yourself or a legally registered organization.

• All information provided by you is accurate and complete.

Gorec.ai reserves the right to verify user identity and business credentials at any time.

2. Account Registration

To access certain services, you may be required to create a recruiter account.

You agree to:

• Provide accurate and current information.

• Maintain the confidentiality of login credentials.

• Restrict unauthorized access to your account.

• Immediately notify Gorec.ai of any suspected unauthorized use.

You remain solely responsible for all activities conducted through your account.

3. Platform Services

Gorec.ai may provide:

• AI-powered candidate sourcing

• Candidate discovery tools

• Resume databases

• Candidate matching

• Recruitment automation

• Talent intelligence

• Job posting services

• Recruitment consultancy services

• Hiring assistance services

• Executive search services

• Other recruitment-related solutions

Gorec.ai reserves the right to modify, suspend, or discontinue any service without prior notice.

4. Credits, Pricing and Payments

4.1 Credit-Based Platform

The Gorec.ai platform operates primarily on a credit-based model. Users may purchase credits through subscriptions, packages, enterprise agreements, or promotional plans.

Credits may be consumed for:

• Candidate sourcing

• Candidate unlocks

• Resume access

• Contact detail access

• AI searches

• Candidate outreach

• Premium platform features

• Other services designated by Gorec.ai

4.2 Credit Validity

Credits may carry an expiry period as communicated at the time of purchase. Unused credits may expire after the applicable validity period.

4.3 Credit Refund Policy

Purchased credits are:

• Non-refundable

• Non-transferable

• Non-exchangeable for cash

except where required by applicable law.

4.4 Taxes

All prices displayed on the Platform are exclusive of applicable taxes unless otherwise stated. Users shall be responsible for payment of all applicable taxes including GST.

5. Recruitment Consultancy Services

Separate from the self-service platform, Gorec.ai may offer recruitment consultancy, executive search, hiring assistance, recruitment process outsourcing (RPO), and managed hiring services.

5.1 Placement Fees

Where a client engages Gorec.ai Recruitment Consultancy Services through a proposal, service agreement, invoice, purchase order, email confirmation, or other written communication, placement fees shall apply.

Unless otherwise agreed in writing, Gorec.ai shall be entitled to a placement fee equal to ten percent (10%) of the hired candidate's annual Cost to Company (CTC).

5.2 Hiring Confirmation

Clients agree to reasonably cooperate with Gorec.ai in confirming hiring outcomes relating to candidates introduced through consultancy services.

5.3 Fee Payment

Invoices raised under recruitment consultancy services shall be payable within the period specified on the invoice. Late payments may attract interest at 18% per annum or the maximum rate permitted by law.

6. Candidate Data Usage

Candidate information available through Gorec.ai is confidential. Recruiters may access candidate information solely for lawful recruitment and hiring purposes.

Recruiters shall not:

• Sell candidate data

• Redistribute candidate data

• Build independent databases using candidate information

• Use candidate information for marketing purposes

• Use candidate information for non-recruitment activities

• Share candidate data with unauthorized third parties

Candidate data remains subject to applicable privacy laws and candidate rights.

7. Recruiter Responsibilities

Recruiters agree to:

• Comply with all applicable laws.

• Use the Platform only for legitimate hiring activities.

• Conduct independent evaluations before hiring decisions.

• Maintain confidentiality of candidate information.

• Ensure compliance with employment, labour, and anti-discrimination laws.

Recruiters are solely responsible for their hiring decisions.

8. AI Features Disclaimer

Gorec.ai may provide AI-generated:

• Candidate recommendations

• Rankings

• Matching scores

• Candidate summaries

• Screening insights

• Hiring recommendations

These outputs are provided solely for informational and assistance purposes. Gorec.ai does not guarantee the accuracy, completeness, suitability, fairness, or reliability of AI-generated outputs.

Recruiters must independently review all information before making hiring decisions.

9. Account Deletion and Data Retention

9.1 User-Initiated Deletion

Users may request deletion of their account through the Platform or by contacting Gorec.ai support.

9.2 Permanent Deletion

Upon completion of account deletion, certain account information, activity history, saved searches, candidate lists, communications, reports, settings, and related data may be permanently removed from active systems.

9.3 No Data Recovery Guarantee

Once account deletion is completed, Gorec.ai may be unable to restore or recover deleted information. Users acknowledge that deleted data may become permanently irretrievable.

9.4 User Responsibility for Backups

Users are solely responsible for downloading or backing up any information they wish to retain before deleting their account. Gorec.ai shall not be responsible for maintaining copies of deleted user data.

9.5 Deleted Candidate Information

Where a User intentionally deletes candidate records, candidate folders, notes, job postings, communication history, reports, or other information, Gorec.ai shall not be responsible for recovering such information.

9.6 Platform Liability

Gorec.ai shall not be liable for loss of data resulting from:

• User actions

• Account deletion requests

• Expired retention periods

• Credential sharing

• Unauthorized access caused by user negligence

• Technical failures beyond reasonable control

• Force majeure events

9.7 Legal Retention

Notwithstanding account deletion, Gorec.ai may retain certain records where required for:

• Legal compliance

• Tax obligations

• Fraud prevention

• Security investigations

• Dispute resolution

• Enforcement of legal rights

10. Intellectual Property

All intellectual property rights relating to Gorec.ai, including:

• Software

• Platform architecture

• Algorithms

• Databases

• Branding

• Logos

• Website content

• Designs

• Reports

remain the exclusive property of Gorec.ai or its licensors. Users receive a limited, non-exclusive, revocable license to access and use the Platform. No ownership rights are transferred.

11. Prohibited Activities

Recruiters shall not:

• Reverse engineer the Platform

• Copy or replicate platform functionality

• Use bots or automated scraping tools

• Access systems without authorization

• Interfere with platform operations

• Upload malicious code

• Create fake accounts

• Misrepresent company information

• Engage in fraudulent activities

Violation may result in immediate suspension or termination.

12. Privacy and Data Processing

Gorec.ai processes personal data in accordance with its Privacy Policy and applicable data protection laws. By using the Platform, users consent to such processing where required by law.

Recruiters uploading candidate information represent that they have lawful authority to do so.

Gorec.ai may engage third-party service providers for hosting, analytics, communication, security, payment processing, and platform operations.

13. Service Availability

While Gorec.ai aims to maintain uninterrupted services, we do not guarantee that:

• The Platform will always be available.

• Services will be uninterrupted.

• Errors will never occur.

• The Platform will always be secure.

Scheduled maintenance, upgrades, technical issues, and external factors may affect service availability.

14. Disclaimer of Warranties

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, Gorec.ai disclaims all warranties, whether express, implied, statutory, or otherwise.

Gorec.ai does not guarantee:

• Hiring success

• Candidate availability

• Candidate accuracy

• Employment outcomes

• Platform uptime

• AI recommendation accuracy

15. Limitation of Liability

To the fullest extent permitted by law, Gorec.ai shall not be liable for:

• Indirect damages

• Consequential damages

• Lost profits

• Lost revenue

• Business interruption

• Data loss

• Hiring losses

• Employment disputes

• Candidate conduct

Gorec.ai's total liability shall not exceed the amount paid by the User to Gorec.ai during the preceding three (3) months.

16. Indemnification

Recruiters agree to indemnify and hold harmless Gorec.ai, its directors, employees, affiliates, agents, and partners against claims arising from:

• Violation of these Terms

• Misuse of candidate data

• Breach of applicable laws

• User-generated content

• Employment disputes

• Hiring decisions

17. Suspension and Termination

Gorec.ai may suspend or terminate access without notice where:

• Terms are violated

• Fraud is suspected

• Candidate data is misused

• Platform security is compromised

• Required payments remain unpaid

Termination shall not affect accrued rights or obligations.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India.

19. Dispute Resolution

Any dispute arising from these Terms shall first be attempted to be resolved amicably.

If unresolved within 30 days, the dispute shall be referred to arbitration under the Arbitration and Conciliation Act, 1996.

The seat of arbitration shall be Udaipur, Rajasthan, India. The arbitration shall be conducted in English by a sole arbitrator. The arbitration award shall be final and binding.
